DMCA Policy

Welcome to our DMCA Policy page. At Virginia PDF Forms, we are committed to respecting and protecting the intellectual property rights of others, just as we expect others to honor our rights. This page outlines our policy regarding the management of DMCA complaints, providing a transparent and straightforward approach to addressing claims of copyright infringement.

Intellectual Property Rights

We hold intellectual property rights in high regard and adhere strictly to the guidelines set forth under the Digital Millennium Copyright Act (DMCA). Our website features a variety of forms, and all content is either owned by us or we have the legal rights to use it. We acknowledge the importance of these rights and strive to ensure that all content on our website respects and complies with applicable laws.

Notification of Infringement

If you believe that your copyrighted work has been published on our website without permission, your authorization, or in a manner that violates your intellectual property rights, we encourage you to notify us. To ensure an effective response, your notification should include:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • A description of the copyrighted work you claim has been infringed;
  • A description of where the material you claim is infringing is located on our site (preferably with specific URL links);
  • Your contact information, including your address, telephone number, and email address;
  • A statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please direct all DMCA notices and copyright infringement claims to dmca@virginiaformspdf.com. We aim to respond promptly to your concerns.

Process

Upon receiving a valid infringement notification, it is our policy to remove or disable access to the allegedly infringing content. We also take steps to contact the content provider, member, or user to inform them of the removal of their content. It’s part of our commitment to not only follow the law but also to ensure a fair and balanced process for all parties involved.

Counter-Notice

If you believe that the content was removed or disabled by mistake or misidentification, you may send us a counter-notice containing the following information:

  • Your physical or electronic signature;
  • Identification of the content that has been removed or to which access has been disabled, and the location at which the content appeared before it was removed or access to it was disabled;
  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the content; and
  • Your name, address, telephone number, and, if available, email address, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by us, we may send a copy of the counter-notice to the original complaining party informing them that we may replace the removed content or cease disabling it in 10 business days. Unless our designated agent receives notice from the original complaining party that an action has been filed seeking a court order to restrain the content provider, member, or user from engaging in infringing activity relating to the content on our website, we may replace the removed content or cease disabling access to it.

We believe in open communication and the protection of intellectual property rights. At Virginia PDF Forms, we are dedicated to following procedures that ensure all parties are treated fairly, upholding the integrity of copyright law.
